Apartment Complex Owner Pays Fine for Failing to Warn Tenants about Lead Paint in Springfield, Mass.

(Boston, Mass. – Nov. 30, 2009) – The owner of a 25-unit apartment building in Springfield, Mass. has agreed to pay a fine of $10,000 to settle an EPA enforcement action alleging violations of federal lead-based paint disclosure requirements.

The real estate company, MA No. 2, LLC (MA2), is a Nevada corporation that owns the Parkview Apartments on Federal Street in Springfield. In March 2006, EPA issued a subpoena seeking information regarding lead disclosure at Parkview. The subpoena response provided EPA with information leading to this enforcement case and the underlying allegations that eight lease transactions from 2004 and 2005 by MA2 were in violation of the Lead Disclosure Rule.

In particular, EPA found that MA2 failed to provide tenants with lead hazard information pamphlets, information and records about known lead-based paint and/or hazards at Parkview, lead warning statements in leases, and statements disclosing the presence of known lead-based paint or hazards, or the lack of such knowledge. As part of the settlement, EPA agreed to withdraw liability claims against another party it had originally named along with MA2, after factual information provided after the case was filed showed that the party was not liable for the Parkview violations.

Infants and young children are especially vulnerable to lead paint exposure, which can cause developmental impairment, reading and learning disabilities; impaired hearing; reduced attention span, hyperactivity and behavioral problems. Adults with high lead levels can suffer difficulties during pregnancy, high blood pressure, nerve disorders, memory problems and muscle and joint pain. While violation of lead disclosure laws can increase the potential for exposure to lead-based paint, information available to EPA does not indicate that any lead poisoning occurred as a result of these violations.

Federal law requires that property owners, property managers and real estate agents leasing or selling housing built before 1978 provide the following information to tenants and buyers: an EPA-approved lead hazard information pamphlet, called Protect Your Family from Lead in Your Home; a lead warning statement; statements disclosing any known lead-based paint and lead-based paint hazards; and copies of all available records or reports regarding lead-based paint and lead-based paint hazards. This information must be provided to tenants and buyers before they enter into leases or purchase and sales agreements. Property owners, property managers and real estate agents equally share responsibility for providing lead disclosure information and must retain copies of records regarding lead disclosures for three years. Currently, MA2 has come into compliance with these requirements.

EPA: Kalamazoo River Superfund update meetings Dec. 1 in Plainwell, Dec. 3 in Kalamazoo

(CHICAGO - Nov. 30, 2009) U.S. Environmental Protection Agency Region 5 hosts two meetings this week to update Kalamazoo area residents on portions of the Kalamazoo River Superfund site.

A general site update meeting will be held Tuesday, Dec. 1, at 6:30 p.m., at the Comfort Inn, 622 Allegan St., Plainwell. The presentation will include an update on planned cleanup activities in Plainwell.

A meeting focused on the Allied Landfill portion of the site will be held Thursday, Dec. 3 at 6:30 p.m., in the Prairies Room of the Radisson Plaza Hotel, 100 W. Michigan, Kalamazoo. This meeting will include a presentation on responsible party Millennium Holdings' recently developed feasibility study covering a range of cleanup alternatives for the former Allied Paper Landfill. EPA will review the study this winter.

Representatives from partner agencies including Michigan Department of Environmental Quality are expected at both meetings.

The complete Kalamazoo River Superfund area stretches 80 miles from Saugatuck on Lake Michigan to the Morrow Dam. EPA and MDEQ's cleanup efforts primarily focus on the removal and containment of PCBs, or polychlorinated biphenyls. PCBs are a group of toxic chemicals that were widely used in carbonless copy paper and as coolants, insulators and lubricants. PCBs are of concern because they concentrate in the food chain resulting in health hazards to people, fish and wildlife. Congress banned the manufacture of PCBs in 1976, and PCBs still in use are strictly regulated.

Leroy Mzhickteno’s oral history is among those highlighted in a new VHP Web Feature, “Willing to Serve: American Indians.”

Nicknamed Mickey, he grew up on the Potawatomi Reservation in Kansas during the Depression. After graduating from high school, he joined the National Guard in 1939 to make money. He was still in the Guard on December 7, 1941, and was soon on fulltime active duty in the Army. His infantry regiment sailed from England to France shortly after D-Day, and they spent the rest of the war chasing the retreating Germans. He was wounded in the back by shell fragments during intense fighting. Patched up and sent back to his unit, he was put in charge of a group of replacements who were more interested in confiscating food and wine than in pursuing the German Army.

The Mission of the Veterans History Project of the American Folklife Center is to collect, preserve, and make accessible the personal accounts of American war veterans so that future generations may hear directly from veterans and better understand the realities of war. After a flawless mission to resupply the International Space Station, the STS-129 crew members now are back at NASA's Johnson Space Center in Houston. They will be honored with a homecoming ceremony at nearby Ellington Field today.

Meanwhile, preparations for space shuttle Endeavour and its crew are ramping up for the STS-130 mission targeted to launch Feb. 4, 2010.

Endeavour is scheduled to roll over from the orbiter processing facility to the Vehicle Assembly Building at NASA's Kennedy Space Center in late December. There, it will be lifted and attached to the waiting external tank and twin solid rocket boosters.

The STS-130 crew members, Commander George Zamka, Pilot Terry Virts Jr., Mission Specialists Nicholas Patrick, Robert Behnken, Stephen Robinson and Kathryn Hire, are rehearsing deorbit procedures today at Johnson.

Endeavour will deliver a third connecting module, the Tranquility node, to the station in addition to the seven-windowed Cupola module, which will be used as a control room for robotics.

(Kansas City, Kan., Nov. 30, 2009) - EPA has awarded $520,400 to Wayne, Neb., for improvements to its wastewater treatment plant project.

 

EPA Region 7 Acting Regional Administrator William Rice said, “EPA is proud to award these water infrastructure funds to protect water quality. Water infrastructure is a lifeline for community health and prosperity.”

 

Wayne’s existing 25-year-old facility continues to generate odor complaints regarding the sludge treatment system. The grant will help construct a wastewater treatment plant which will address odor concerns.

 

EPA oversees the protection of water quality and public health. The Agency is working with community leaders and the public to meet the growing needs and demands of our limited water resources. EPA remains committed to developing innovative and sustainable solutions for managing and financing infrastructure with public and private partners.

After a flawless mission to resupply the International Space Station, the STS-129 crew members now are back at NASA's Johnson Space Center in Houston. They will be honored with a homecoming ceremony at nearby Ellington Field today.

Meanwhile, preparations for space shuttle Endeavour and its crew are ramping up for the STS-130 mission targeted to launch Feb. 4, 2010.

Endeavour is scheduled to roll over from the orbiter processing facility to the Vehicle Assembly Building at NASA's Kennedy Space Center in late December. There, it will be lifted and attached to the waiting external tank and twin solid rocket boosters.

The STS-130 crew members, Commander George Zamka, Pilot Terry Virts Jr., Mission Specialists Nicholas Patrick, Robert Behnken, Stephen Robinson and Kathryn Hire, are rehearsing deorbit procedures today at Johnson.

Endeavour will deliver a third connecting module, the Tranquility node, to the station in addition to the seven-windowed Cupola module, which will be used as a control room for robotics.

EPA Issues Consumer Alert: Unscrupulous Vendors Market Unapproved Flu Disinfectant Products

WASHINGTON – The U.S. Environmental Protection Agency is warning consumers to beware of unscrupulous vendors who may market ineffective and unregistered products or services that claim to disinfect surfaces or entire rooms against the H1N1 influenza virus. In the current flu-conscious climate, heightened anxiety about the spread of the H1N1 virus has bred false claims in the marketplace.

“Unfortunately some vendors may try to take advantage of people’s fears at a time like this and market products that aren’t effective or make unsubstantiated claims,” said Steve Owens, assistant administrator for EPA’s Office of Prevention, Pesticides and Toxic Substances. “Americans need to be aware of what they may be buying.”

EPA registers disinfectants for use on hard surfaces, and when used according to label directions, such products will be effective against influenza A viruses, including the 2009 H1N1 pandemic strain. There are no products registered by EPA for use in residential settings that will disinfect or sterilize the air or a room by fogging. Claims for disinfecting carpeting, drapes and other porous surfaces are also false. The products approved by EPA are for use on hard surfaces only, and the label must state that the product is registered for the influenza A virus.

It is important to follow label instructions to ensure the safe and effective use of these products in specific sites, including health care settings, homes, schools, offices, and farms. A list of more than 500 antimicrobial products registered by EPA for use against the influenza A virus and H1N1 on hard surfaces is available on EPA’s Web site.

The public is encouraged to follow the Centers for Disease Control and Prevention’s recommendations for preventing the spread of the 2009 H1N1 influenza A virus, which stresses frequently washing your hands with soap and water.

Bennie began playing learning Scandinavian folk tunes from fiddlers in his rural Wisconsin immigrant community. These tunes became the backbone of the repertoire for the Berntsons. In the 1930s, Bennie Berntson's son Maurice and daughter Eleanore joined the family music circle. Today, the Berntsons are alive and well, and heading into their second century of music-making.

Commander Charles O. Hobaugh took the lead describing how well Atlantis performed from launch to landing, and the incredible amount of work that went into preparing both the shuttle and the crew for this ambitious mission.

Hobaugh proudly introduced his crew and the tasks each member was responsible for. He mentioned Mission Specialist Randy Bresnik was not present at the briefing because he flew home to be with his wife and new baby girl, born while he was still on orbit.

Nicole Stott is doing really well, said Hobaugh, after her 91 days in space, 80 of them as flight engineer. She's enjoying Thanksgiving dinner with her family.

Mission Specialist Robert L. Satcher Jr. remarked that the training the crew members received helped them deal with the false alarms that went off a few times during their stay on the orbiting outpost.

After being asked if there were any memories that stood out, Pilot Barry E. Wilmore jokingly said, "I feel great (but) I had noticed that many of the buildings here are on a little bit of a teeter-totter that I didn't know before." Wilmore was referring to coming back to Earth's gravity after being weightless in space.

The crew members fly back to NASA's Johnson Space Center in Houston on Saturday. They’ll have the traditional Houston homecoming celebration on Monday.

During a post-landing press conference held at NASA's Kennedy Space Center in Florida, Bill Gerstenmaier, associate administrator for Space Operations said, "This has just been an amazing mission. On-time launch, on-time landing ... just a phenomenal team effort across the board."

Gerstenmaier also gave special thanks to the production workers who prepared the hardware for this flight, especially those who have taken voluntary retirement and have been laid off as part of the staff reduction requirements.

"There's still a lot of activity in front us … still a very busy time," continued Gerstenmaier. "The teams are focused -- we're moving forward and doing great things."

Shuttle Launch Integration Manager Mike Moses agreed that this was an incredibly smooth mission. "It's great to have Atlantis back here at Kennedy," said Moses.

"We have a lot to do," Moses said regarding the remaining space shuttle flights. "We'll need to be diligent and stay focused."

Mike Leinbach, NASA shuttle launch director, said, "The orbiter looks really good, and the crew is doing fine and they reported that Nicole Stott is doing fine as well, so good news there."

"Everything is going really, really well, the orbiter looks great. It's fantastic to be a part of this team. I'm very, very proud of team Atlantis … and looking forward to her next mission."
